Greetings members.  By regular mail you will receive the 2022 dues invoice and the 2022 budget. Details for the 2022 budget will be presented at the 2022 Annual Meeting.  Please contact Treasurer Debbie Little for questions on the invoice or budgets. Please note that dues have increased to $240 for lots serviced by Association Road and to $90 for roads not serviced by Association Roads.

The summer was dryer and hotter than normal, and with those conditions and increased traffic, roads took a beating.  The major road event this past year was graveling Pilgrim Ridge and purchasing Grading F gravel for application in 2022 to the steeper, corrugated sections of roads. The grader did not require transmission work, so that money was used towards the purchase the gravel for 2022. Unauthorized work was done to an easement area by a member who was not the owner of the affected lot, but the member who performed the work graciously agreed to repair the damage at his expense. The sign that was torn down at the intersection of Shuck Creek and Hammer Creek was replaced, along with a new sign warning motorists of the unimproved condition of that section of Shuck Creek. There were several fires on the Ranch this year – Saddle Ridge, off of Doumecq, and Elk Run. All fires were immediately contained by property owners mainly because they were easily accessible. There were several large fires in the general area, the Dixie fire being the largest.

Three homes have been started this past year, two are still in progress but should be finished this fall or winter, 24 lots have sold, and eight properties are currently listed. You can follow available listings and other local news on www.trr-thisandthat.com.

The Annual Meeting and Picnic were held this year.   Details on the Annual Meeting and Board meetings throughout the year can be found on our website. Three board members’ terms expire next June (Pat Hurt, John Urbahn and Debbie Little). Debbie Little, our Treasurer, is seeking re-election. If any members wish to run for the board, we are suggesting a brief letter be sent to the board as to why you would like to run and what you see as to your contributions to the board. Please send your letter by April first of 2022 so it can be included in the May newsletter next year. Nominations will still be taken from the floor at the June 2022 annual meeting. 

We are asking everyone to include their current email address and phone number on their invoice when they return it so we can make sure our records are up to date.  Thank you very much.

October 29, 2021 Board Meeting

Minutes, Board of Directors Special Meeting

October 29, 2021

Call to Order:  President Pat Hurt called the meeting to order at 10:07 AM at the old White Bird School.  Present were Pat; John Urbahn, Vice President; Debbie Little, Treasurer; Susan Schubert, Secretary; Cathy Little, Fire Tree; Wolfgang Schubert, Road Chairman; and Kristin Donaldson, Webmaster. Members in attendance were Mark and Shelly Frayser.  

2022 Budget:  A motion was made, seconded, and all approved to raise all Association dues by 20% starting with 2022.  Lots serviced by Association roads will go from $200 to $240; lots not serviced by Association roads will go from $75 to $90.  Debbie reported the income for 2022 will be $44,760. There are currently five properties that are past due. The budget was approved with two changes.  An additional $3,000 was moved from the excess of $8,800 to the Road budget for more gravel and $500 was moved to the Annual Meeting budget for the purchase of a PA system.  $5,000 of the excess will be put in the reserve account to continue the effort to build up the reserves.  A copy of the budget is included.  Please contact Debbie Little if you have any questions.

Other Business:  Wolfgang reported we will need approximately 80 loads of regular gravel for 2022.  Grading F has already been purchased for the steeper sections.  No decision has been made on using a roller for the Grading F application. Grader repairs included replacing a gasket on the starter. The grader has been smoking and may require a new head gasket. Wolfgang did not have an estimate yet for that.  

Cathy reported there have been hunters trespassing on the unimproved section of Pine Ridge. Owners have requested the road be gated, but it cannot be as it is an Association road.  It was decided to put additional no trespassing signs with no public access and no hunting at the three unimproved sections of roads – Pine Ridge, Shuck Creek, and Canyon.  Cathy will order them after the first of the year.

Member Forum: Mark Frayser questioned why all lots don’t pay the same amount, $240.  Pat explained it would take a change to the CCR&Rs to make all pay the same, and that members wishing to change the CC&Rs start with sending a letter to the Board with their request.

June 24 Board of Directors Special Meeting

June 24, 2021

Call to Order:  President Pat Hurt called the meeting to order at 5:00 pm at his home on Schuck Creek Road.  Board members present were Pat, Debbie Little, Treasurer; Susan Schubert, Secretary; Cathy Little; Wolfgang Schubert, Road Chairman; and Kristin Donaldson, Webmaster. 

Raising Dues: The purpose of the meeting was to discuss if the Board has the authority to raise dues on lots not served by Association Roads from the current assessment of $75.  Several members at the Annual Membership Meeting had challenged if the Board could do this with one member claiming to have discussed with her lawyer who said we had no authority to raise those dues.

Pat discussed the issue with the Association lawyer, Joe Wright, and presented a letter from Joe.  A copy of the letter will be filed with the minutes.  The letter explained that Idaho Courts typically rule in favor of the property owner’s right to use their property in cases where Homeowner’s Association covenants restrict that use in ways that are not clearly defined in the covenants.  Joe does not feel that raising dues has anything to do with restricting an owner’s right to use their property, and that the Association can raise the dues as stated in the CC&Rs and would win if it went to court or to binding arbitration.   All agreed to proceed with raising all lots’ dues by 20 percent as previously voted on in the event that the $100 increase failed.

Other Business:  Pat requested that the tables be set up different next year and that we use a PA system, limiting comments from the floor to the person currently holding the microphone.

Pat would like some Grading F gravel put down on the roads prior to sending out the statements with the dues increase so owners can see the benefits of spending more money on maintaining the roads.

Alternatives to maintaining the roads by an Association employee were discussed, such as contracting out to a road maintenance or construction company.  The majority voted to keep the current arrangement of having our own grader and employee.

Officers were elected and remain the same as the previous term.

Cathy presented a writeup for the Annual Meeting minutes explaining the election results.  She also gave the voting sheets to Susan along with the tally.

Responding to those not serviced by Association roads who complain that they get nothing for their $75, the Board would like to remind them that they get the protection of the covenants against uses not allowed on neighboring lots.  Other members not served by Association roads do want the protection of the covenants.

The unimproved section of Pine Ridge is the only access to one of the lots.  It is currently blocked in several places by trees and debris.  The Board decided to get an estimate from Robin to open it up enough to get a four wheel drive Jeep or ATV through.

June 18 Board Meeting Minutes

June 18, 2021

Call to Order:  President Pat Hurt called the meeting to order.  Board members Pat, Debbie Little, Cathy Little, Wolfgang Schubert, John Urbahn and David Bennett were present.  Susan Schubert, previous board member and secretary, volunteered to take notes.  At this time it was believed that David had won the Board seat previously held by Susan.

No business was conducted.

2021 Annual Members Meeting

Annual Members Meeting Minutes

June 18, 2021

The Confluence Resort, White Bird, Idaho

Call to Order: The meeting was called to order at 10:30 AM by President Pat Hurt.  Present were John Urbahn, Vice President; Debbie Little, Treasurer; Susan Schubert, Secretary; Kristin Donaldson, Webmaster; Wolfgang Schubert, Road Chairman, and Cathy Little, Fire Tree Coordinator.  Robin Lipinski, Equipment Operator, was also present with the Board.  There were approximately 60 plus members in attendance.

President’s Message:  Pat asked new members to stand up and introduce themselves.  He then introduced the Board members.  He announced that the Library and EMTs were raising money for a new AED for the Silver Dollar.

Nomination and Election of Board Members: Kristin Donaldson and Susan Schubert, whose terms expired, were running for another term.  David Bennett nominated himself from the floor.

Voting Commenced.  Three items were voted on: 1) Two open Board positions; 2) Limiting the spending power of the Board to $5,000 for nonemergency and nonbudgeted items; 3) Raising dues on lots accessed by Association Roads, i.e., those currently paying $200, by $100 to $300.  Ballots were collected, and the meeting resumed.

Limiting Powers of the Board.  There was a lengthy discussion by a select group of property owners on removing all power from the Board except the power and responsibility to maintain roads and on removing all CCRs.  A motion was made and seconded to that effect.  President Pat Hurt requested the motion in writing.  No action was taken.  The Board would like to remind those property owners that removing all CC&Rs would result in no dues required or collected, therefore no monies for road maintenance.

Road Report.  Wolfgang Schubert started his road report but was not able to finish as the meeting quickly became a lengthy discussion about the condition and maintenance of the roads.  Many suggestions were made, and opinions voiced.  No action was taken as a result of the discussion.  A copy of the road report is available upon request.

Salmon River Rural Fire District. John and Annelle Urbahn gave a presentation on the Salmon River Rural Fire District (SRRFD).  Open burning is over, and permits to burn are now required from the Forest Service. There have been four fires on Association properties already this year.  Property owners should be prepared to defend their properties for at least an hour in the event of a fire as the SSRRFD is an all-volunteer department, and it will take them time to respond.  More volunteers are needed.  A background check is required to be a volunteer, and SRRFD will pay up to $10 towards the background check.  There is a phone app available to help track where fires are.  Call 911 to report a fire.

Treasurer’s Report: The following documents were given to those in attendance: Income Statement and Annual Budget for Five Months Ending May 31, 2021; Balance Sheets May 31, 2021 and 2020.  Debbie reported that unpaid dues in the amount of $5,000 were collected and put in the reserve account.  The total amount collected from dues annually at the current assessment would be $37,300 if all members paid.  Debbie shared that the cost of graveling all roads in a previous year was $38,000.  It was moved, seconded, and passed to approve the Treasurer’s Report.  A copy of the treasurer’s report is available upon request.

Voting Results:  The increase in dues by $100 for lots served by Association roads did not pass.  The Board will proceed with a 20 percent increase in dues on all lots.  The limit of $5,000 on the Board’s spending on nonemergency and nonbudgeted items passed.  The election of Board members, with the tally of votes, both the proxies received by the Board and the votes of attendees at the meeting, Kristin Donaldson secured enough votes to win a position; however, it appeared that neither Susan nor David received the required 51% of the vote required to secure a position.  A revote was done for those two candidates.  After that vote, Cathy Little realized that she failed to give 36 proxy voting sheets to the woman (who is not a property owner) who was counting the ballots during the first go round.  A recount was then done by both Cathy and the woman, and the vote count showed the election of both Susan and Kristin to serve on the Board.  Still another count by a non-board member was done on June 20th that validated the election of both Susan and Kristin.  A memo of the validity of the count was signed by the non-board member who completed the June 20th count.

From The Floor: There was more discussion about roads and what the Board’s role should be in enforcing covenants.  No action was taken as a result of the discussion.

Meeting Adjourned: Pat adjourned the meeting shortly after noon so folks could get to the picnic.  The picnic was well attended.
